It's a Super Bowl victory, four years late.
A federal appeals court has tossed out the $550,000 FCC fine against CBS for the Janet Jackson Superbowl "wardrobe malfunction."
I'm sure it'll all be appealed again in some form or another, but hey, a win's a win.
The appeals court said, in this case, the FCC changed it's nearly 30 year practice of fining indecent programs that were so "pervasive as to amount to 'shock treatment' for the audience."
There is also a big debate over the issue of "fleeting images."
It always used to be that a fleeting image, something the broadcaster couldn't really control, would not be fined.
But the FCC has changed its own rule on that one too... Remember Bono and the "F" word at the Golden Globes?
It's a huge mixed message that has thrown newsrooms and all of broadcast for a loop..
Can you say the word "pissed" on TV?
And what about the double standard for sports?
How many times have you seen an athlete mouthing profanity after a bad play?
Where are the fines for that?
This will all end up in the U.S. Supreme Court one day.
We'll see if the highest court in the land can provide some clarity.
