No Charges For Suspect In Calif. HS Rape Indicent

Authorities said Friday that one of six suspects arrested in connection with the gang rape of a 15-year-old girl outside California's Richmond High School's homecoming dance would not be charged.
Contra Costa County Deputy District Attorney Dara Cashman said criminal charges wouldn't be filed against 21-year-old Salvador Rodriguez due to insufficient evidence, reports CBS station KPIX-TV.
The Richmond resident was released from jail late Friday.
Prosecutors have filed charges against four other suspects in the case. San Pablo residents Cody Ray Smith, 15, and Ari Abdallah Morales, 16; Pinole resident Marcelles James Peter, 17; and Richmond resident Manuel Ortega, 19 were arraigned in court on Thursday.
The three juveniles each were charged as adults with rape by a foreign object while acting in concert. Morales was also charged with robbery, according to the criminal complaint.
Ortega has been charged with forcible rape while acting in concert, assault with force likely to cause great bodily injury, and robbery.
A fifth suspect, 18-year-old Jose Carlos Montano of San Pablo, remained in custody on $1.3 million bail although he had yet to be charged.
Montano was being held in the county jail following his arrest Thursday evening on suspicion of rape, rape in concert with force, penetration with a foreign object and a special enhancement requesting life in prison.
Richmond Police Lt. Mark Gagan said Friday that investigators were still looking for additional suspects in the case. The victim was attacked after leaving a homecoming dance at the high school Saturday night.
