Judge: State Violating Law On HIV Health Care
LOS ANGELES (AP) ―
A judge's ruling that the state is violating a law that extends Medi-Cal coverage to people with HIV is forcing state health officials to review their practices.
The ruling, issued in Los Angeles Superior Court, follows a lawsuit filed last year by the AIDS Healthcare Foundation.
The foundation alleged the Department of Health Care Services had done nothing to comply with the state law passed in 2002.
Before the law's passage, HIV-positive people were disqualified from the Medi-Cal program until they developed full-blown AIDS.
A judge ruled in favor of the nonprofit foundation last month, and asked its attorneys to return Dec. 17 to submit a plan on how the state can comply with the law.
Norman Williams, a deputy director for DHCS, says the state lacks funding to comply.
