The Porn Wars that were fought in federal court this week between smut king Larry Flynt and his estranged nephews ended with a split decision.
After three days of testimony, a jury ruled Friday that Flynt's nephews, Jimmy Flynt Jr. and Dustin Flynt, infringed on their famous uncle's trademark when they launched a company last year called Flynt Media Corp. At the same time, jurors rejected Flynt's claims that the action invaded his privacy.
The latter ruling, the nephews' lawyer, Dan DeCarlo says, allows his clients to ask that the court order Larry Flynt to pay attorney fees.
The nephews, meanwhile, must put their first names on their porn flicks if they want to stay in the smut business using the name Flynt.
