A Superior Court judge has ordered lawyers for an 89-year-old man convicted of killing 10 people with his car at an outdoor market to respond to allegations that they made improper contact with jurors.
Prosecutors told the judge that three jurors complained they were contacted by a defense investigator against their wishes after the trial of George Russell Weller.
The two defense attorneys were ordered to appear in court Monday.
They said they were permitted to contact jurors and that they wanted to question the former panelists about what they
characterize in court papers as three instances of misconduct during deliberations.
They said jurors concealed bias, talked to non-jurors about the case and deliberated outside the presence of some jurors.
Weller was convicted last month of ten counts of vehicular manslaughter with gross negligence in the July 2003 crash.
