Murder and attempted murder charges were filed Wednesday against a man, 26, accused of running over his girlfriend and his uncle, who survived with a compound leg fracture, after ordering them both out of the car in a pounding rainstorm.
Carlos Gutierrez is scheduled to be arraigned Wednesday afternoon at the Airport Branch Courthouse in Los Angeles on charges of murdering Yolanda Martinez, 37, and trying to kill Antonio Gutierrez, early Monday morning.
Along with one count each of murder and attempted murder, the criminal complaint alleges that Gutierrez used a deadly and dangerous weapon, a car, in the commission of the crimes.
Police told the Los Angeles Times that Gutierrez -- after a night of drinking at a Silver Lake club -- got so angry at the victims that he ordered them out of his car in a rainstorm. As they began walking away from the car, he allegedly gunned the engine of his Honda Prelude and plowed into them.
Gutierrez then allegedly put his mortally injured girlfriend into the back seat of the car and his uncle in the passenger seat and drove about 20 miles to a gas station in Pacific Palisades.
As Gutierrez prepared to pump gas into his car, his uncle managed to drag himself out of the Prelude and began screaming for help, prompting onlookers to call 911, according to the newspaper. But it was too late for Martinez, who was pronounced dead at the scene.
