Man Charged With Raping Woman On I-5 In O.C.

Bodily Fluid Links Leyva To Alleged Rape Of 24-Year-Old Woman

SAN JUAN CAPISTRANO, Calif. (CBS) ― A man who allegedly raped a 24-year-old woman who became stranded on the San Diego (5) Freeway early Saturday morning following an accident has been charged with forcible rape, two counts of sexual penetration, sexual assault with the intent to commit rape, dissuading a witness and making a criminal threat.

Alejandro Martinez Leyva, 25, faces up to 23 years in prison if he is convicted of the six charges.

The Orange County Sheriff's Department found a DNA sample positively linking Leyva to the rape of a woman near an off-ramp from the San Diego (5) Freeway in San Juan Capistrano, it was reported Thursday.

Sheriff's Department spokesman Jim Amormino said the sample, which consists of bodily fluid, was found at the crime scene.
